Québec's framework

The Criminal Code bans gambling in principle, then carves out an exception: section 207 lets each province conduct and manage lottery schemes, including by computer. In Québec, that power belongs to Loto-Québec. Its online platform, launched in 2010 as Espacejeux, is the only one authorized in the province, and there is no licensing regime for private operators.

The grey zone: not licensed, not quite banned

Yet offshore-licensed online casinos accept Québec players. They hold no Québec authorization, but they aren't based in Québec, and the Criminal Code targets those who run gambling, not those who play. To our knowledge, no player has been prosecuted in Québec for playing on an offshore site.

That gap is what people call the "grey zone": the offshore offer isn't authorized, but nothing actually stops it from reaching Quebecers. The flip side matters: if a withdrawal is refused or an account closed, the player has to go to the operator, then to the foreign authority that licensed it. No Québec body can rule on it.

Bill 74 and its defeat in court

Québec tried to close that door. Passed on May 17, 2016, Bill 74 added sections 260.33 to 260.37 to the Consumer Protection Act: internet providers would have to block unauthorized gambling sites from a list drawn up by Loto-Québec.

The Canadian Wireless Telecommunications Association challenged it. On July 18, 2018, Justice Pierre Nollet of the Superior Court declared the provision unconstitutional (Association canadienne des télécommunications sans fil c. Procureure générale du Québec, 2018 QCCS 3159). In his view, behind the stated goal of consumer protection, the law mainly served to let Loto-Québec block its competitors, and it intruded on two exclusive federal powers: telecommunications and criminal law.

The Court of Appeal upheld the ruling on May 5, 2021 (2021 QCCA 730), confirming that federal jurisdiction over telecommunications extends to online communications. The Supreme Court of Canada then declined to hear the government's appeal. Since then, Québec has had no legal tool to block offshore sites.

Kahnawake: another Québec exception

The grey zone also has a very local address. In 1996, the Mohawk Council of Kahnawake, about 15 km south of Montréal, set up its own gaming commission. It licenses online operators under Mohawk law, a framework separate from provincial and federal law that has never been folded into Loto-Québec's regime. Seeing "Kahnawake" on a casino's licence doesn't mean the site is authorized by Québec.

Elsewhere in Canada: two provinces opened up

Ontario opened a regulated private market in April 2022, overseen by the Alcohol and Gaming Commission and iGaming Ontario. In November 2025, the Ontario Court of Appeal went further, confirming the province could let its players face international players at poker and daily fantasy contests (2025 ONCA 770). Alberta followed with its own regulated market on July 13, 2026. In both provinces, offshore-licensed operators no longer have a place, and our offers aren't available there.

The 2026 political debate

In May 2025, Finance Minister Eric Girard shut the door: Québec had no intention of licensing private operators. The issue came back during the fall 2026 election campaign. On September 9, the Québec Liberal Party proposed requiring online gaming platforms to get accredited by the government, and the Parti Québécois also pledged to end Loto-Québec's monopoly through licensing. The Coalition québécoise du jeu en ligne, which groups private operators, welcomed both commitments.

Not everyone agrees: problem-gambling specialists, including psychologist Louise Nadeau, argue a licensing market risks increasing harmful gambling rather than reducing it. We'll update this page based on what the next government does.
